Florida's Drug-Free
Workplace

In January, 1991, Florida's
Department of Labor established a Workers Compensation insurance premium
credit provision for employers certified as providing a drug-free
workplace. The Florida Drug-free Workplace Program, based on rules adopted
by the Division of Workers Compensation, became effective on January 1,
1992.
Employers who implement a Florida Drug-free Workplace
Program become eligible to receive a Workers Compensation insurance
premium discount, and can deny benefits after an accident if the employee
tests "positive" for illegal drug use.
Specific conditions must be
satisfied by the employer before certification by the Workers Compensation
carrier can be granted. A Medical Review Officer is required to review all
test results, and the laboratory performing the testing must be certified
by the Florida Department of Health and Human Services.
